Although the New York state government claims that hate crimes against Asian Americans have decreased, the issue of Asian American crime remains a serious concern.

On the afternoon of December 10, 2023, Chairman Lin and his family were dining at a McDonald's in Long Island. An unidentified person complained to McDonald's employees, criticizing Chairman Lin's family for bringing a dog into the restaurant and making discriminatory remarks against Chinese people. Chairman Lin stood up to communicate with the unidentified person and then prepared to go to the restroom. At this moment, the unidentified person suddenly attacked Chairman Lin's face twice, hitting his mouth and nose respectively, causing his nose to bleed.

Chairman Lin decisively dialed 911, but the unidentified person attempted to flee further. Fortunately, a helpful passerby and Chairman Lin's family members stopped the unidentified person. Since Chairman Lin was a law enforcement officer, he immediately drew handcuffs and attempted to arrest the person with the help of others, but the arrest process became violent. Fortunately, Long Island police arrived in time and successfully arrested the assailant.

After being attacked, Chairman Lin did not immediately retaliate or draw his service weapon, thus avoiding potential charges of mutual assault or threatening others with a firearm. Instead, he calmly dialed 911. The attacker then attempted to flee, but Chairman Lin and others apprehended him, in accordance with the legal provisions for law enforcement arrests and citizen's arrests . Notably, during the arrest, Chairman Lin and others did not use excessive force, which was acknowledged by the Long Island Police Department.

Attorney Yuen also pointed out that if the attacker continues to assault the victim after the initial attack, then according to the principles of self-defense law, the victim can legally use pepper spray or other compliant means to retaliate until the attacker stops. When the attacker uses a deadly weapon to attack the victim, and the victim's life is under mortal threat, the victim has the right to use firearms or other legal means to launch a deadly counterattack, which is in accordance with the law.

Finally, the New York Firearms Association (NYFA) sincerely wishes everyone a pleasant and safe life in the United States.
